Terms of Service

These terms are a translation of the Korean terms. If the two differ, the Korean version prevails.

1. About these terms

These terms set the conditions for using Nelson, provided by Ownpace ("we", "us"): the Mac app, the iPhone app and keyboard, and the heynelson.io website (together, the "Service"). They describe your rights and ours.

2. Taking effect and changes

  1. These terms are posted in the Service and on the website and apply once you sign up.
  2. We may change these terms within the law. We announce what changes and when 7 days in advance (30 days for changes that are less favorable to you).
  3. If you do not agree with a change, you can stop using the Service and delete your account. Continuing to use it after the change takes effect means you accept it.

3. Your account

  1. You sign up by signing in with Apple or Google. You must be 14 or older.
  2. You are responsible for your account and must not let anyone else use it.
  3. You can delete your account at any time in the iPhone app under Settings → Delete account, or by emailing support@heynelson.io.

4. What the Service does

  1. The Service polishes and translates the English text you ask it to, explains expressions, and collects expressions and grammar points worth learning.
  2. Results are produced by AI models. We work to make them accurate, complete, and useful, but we do not guarantee that they are. Check important text yourself before you send it.
  3. We may change the Service for operational or technical reasons and will tell you in advance about changes that matter to you.
  4. We may limit how many requests can be made in a period of time, to keep the Service fair and stable.

5. Paid plans

  1. We may offer some features for a fee. Prices, what is included, and how to pay are shown on the purchase screen.
  2. Subscriptions bought in the App Store are billed, renewed, canceled, and refunded under Apple's terms. A subscription renews automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel it in iPhone Settings → Apple Account → Subscriptions.
  3. Subscriptions bought on our website are handled by our payment provider (Polar) and can be canceled as shown at checkout. Withdrawals and refunds follow applicable Korean consumer protection law.
  4. We may let new users try paid features for free for a limited period. When the trial ends, your account moves to the free plan unless you subscribe, and you are not charged.
  5. Features described as "unlimited" on a paid plan have no usage count for ordinary personal use. Use far beyond that, such as bulk automated calls, may be limited under section 4.4.

6. What you must not do

  1. Use someone else's personal data or account without permission
  2. Use the Service to process text that breaks the law or infringes others' rights
  3. Call the Service in bulk by automated means, or provide its results to another service without our permission
  4. Reverse engineer the Service or get around its security
  5. Interfere with the operation of the Service

7. Your content

  1. You own the text you enter and the results the Service produces for you.
  2. We process them only as needed to provide the Service and never use them to train AI models. See the Privacy Policy.
  3. We own the Service itself, including its software, design, trademarks, and the Nelson character.

8. Suspension and termination

  1. If you break section 6, we may limit your use or close your account after telling you. In urgent cases we may act first and tell you afterward.
  2. You can object by emailing support@heynelson.io.

9. Interruptions

We may pause the Service for maintenance, failures, network problems, or outages or policy changes at outside services. If we end the Service, we will tell you 30 days in advance.

10. Limits on our liability

  1. We are not liable for losses caused by natural disasters, by you, or by outages at outside services we do not control.
  2. Unless we acted intentionally or with gross negligence, we are not liable for losses from using a result without checking it.
  3. For free features, unless the law provides otherwise, we are liable only for losses caused by our intent or gross negligence.

11. Governing law and disputes

These terms are governed by the laws of the Republic of Korea. We will first try in good faith to resolve any dispute with you; if that fails, it goes to the competent court under the Korean Civil Procedure Act.
